If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.
Permission is granted to use the materials on Companies web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any copied/downloaded materials in your possession whether in electronic or printed format.
MEMBERSHIP PROGRAM/SERVICE
Membership Subscription
Subscription Plans: The Website offers various Membership subscription plans with differing durations. You agree to pay the applicable subscription fees as indicated on the Website.
Tara Prendergast, The Biscuit Factory (herein referred to as “Tara Prendergast” or “Company”) agrees to provide Program, “The Biscuit Factory Membership” (herein referred to as “Program”) identified in the online commerce shopping cart. As a condition of participating in the Program, you agree to be bound by and to abide by all policies and procedures set out in this Agreement, including those incorporated by reference.
As part of the Biscuit Factory Program, Tara Prendergast (herein referred to as “Company”) shall provide the following to Client:
A Password Protected Program Area: The Company shall maintain a Program Area that will include video, audio, and written lessons, templates, worksheets, checklists, slide decks, and other training and support information.
From time to time, the Company will offer bonuses to individuals who sign up for the Biscuit Factory Membership. You shall be entitled to any bonuses offered to you at the time of your enrollment. Bonuses are not guaranteed to be available for the entire lifespan of the program and they vary depending on specific live and automated promotions throughout the year.
Depending on the Subscription Plan you subscribe to you might be eligible to 1:1 Live Sessions with Tara as a part of the bonus category. You’ll get access to 30 minute live sessions with Tara which will be recorded and available for replay. The Company reserves the right to discontinue these one-to-one sessions at any time without any advance notice.
Access to Material
Content Availability: As a Member, you will have access to exclusive content, resources, and services available on the Website.
Usage Restrictions: You agree to use the materials provided to you as part of your Membership solely for your personal and non-commercial use. Redistribution, reproduction, or sharing of content without prior written consent from The Biscuit Factory is strictly prohibited.
Fees
You shall pay all fees specified in any subscription to Services or use of the Site (“Subscription”). We will charge you a periodic fee based on the Subscription you choose. Such fees shall be billed in advance for each period and are non-refundable except as specifically mentioned in these Terms of Service. Except for refunds provided for cancellation of Subscriptions within the first seven (7) days (as described in the section below entitled Cancellation and Termination and in the Biscuit Factory Refund Policy), there will be no refunds or credits for partial months of service or for periods in which your Subscription remains active but you do not use the Services.

The Member is solely responsible for the use of the Biscuit Factory Courses and Services. The availability of the Biscuit Factory Courses and Services throughout the subscription period does not entitle the Member to a refund if the Services are not utilized.
We reserve the right to modify our billing rates at any time upon thirty (30) days written notice by posting such fee changes to the Services or on the Site.
You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with your Subscription at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions, or other monetary transaction interactions.
All prices listed, fees, charges, and refunds are issued in EUR / € . We make no guarantees as to the exchange rate between any currencies, or that the exchange rate will remain unchanged during any period of time. The cost of Services may increase or decrease over a given period of time depending on the currency you choose to pay with and the specific exchange rate at that time. Refunds are likewise issued in EUR / € and are subject to exchange rate volatility. There will be no additional refunds or credits issued in consideration of current or eventual exchange rates. You are responsible for any currency exchange taxes, fees, or other costs that may incur by making a purchase of our Services.
In consideration of Your access to the Program, you agree to pay the following fees:
You may choose between a single payment of €799 (due immediately) or annual payment plan every 3 months of €199.75. If you elect to pay for The Biscuit Factory Membership in full, you can pay in one payment of €799 . If you select the payment plan, you must pay the initial payment today and then your selected payment method will be automatically charged the following 3 payments every three months, for a total payment of €799. If you opt for monthly payments of €79, you will remain responsible for those payments unless you cancel your Membership. You can also opt-in for the monthly subscription Basic Package of €14.99 that includes monthly workshop replays and invitations to all meetups and events in the Factory. In the event that any payment is not made, the Company shall immediately suspend your access to the Biscuit Factory Membership.
CANCELLATION AND TERMINATION
Cancellation
You may cancel your Membership at any time by following the cancellation procedures and Refund Policy outlined on the Website. Upon cancellation, your access to Membership benefits will cease at the end of the current subscription period, and you will no longer have access to the content, courses, or any other materials provided as part of your Membership. Additionally, you will be removed from the system, and your account will be deactivated.
It is a members only site which means only members get access to the platform and its content. Once you cancel your subscription you are unable to access any course material or replays held in the Factory library.
If you wish to cancel your Subscription, you can do so by logging into your account and proceeding with this option through the billing section menu. If you are unable to find this option within the billing section or if you have questions or need assistance, please contact Support at marina@biscuit.ie and they can assist you with the cancellation process. You will remain liable for all charges accrued on your account up to the time that you downgrade or cancel your Subscription, including full monthly fees for the month in which you canceled, provided however that if you cancel your Annual Subscription within the seven (7) days of enrolling into The Biscuit Factory Membership, you may request a refund of your Subscription fee. Refunds are not available for monthly subscriptions and Payment Plans.
REFUND POLICY
We take Your investment seriously, and We’d appreciate it if You took Our investment of time and resources into Your success seriously, too.
Due to the nature of the services and/or products provided, refunds will be provided only as specified in the terms and conditions.
The Biscuit Factory no-risk money-back guarantee offers that, if at any time within the first 7 days of enrolling into the Biscuit Factory you decide that The Biscuit Factory is not for you, then just let our awesome support team know (we make it easy!). The 7-day money back guarantee is valid for the annual payments ONLY.
All other subscriptions are not eligible for refunds. We will stop your Subscription and issue you a refund. Your request for a refund must be received within 24 business hours of the 7 days of the date and time of subscribing into the Biscuit Factory. While some refunds may be instant, refund credit can take up to 5 – 10 business days to show up in your credit card statement.
If adequate notice is not received and your credit card is subsequently charged, you will not receive a refund.
Monthly Subscriptions
Refunds are not available for monthly subscriptions. All sales are final, and no refunds will be issued.
Payment Plans
Payment plans cannot be canceled once initiated. All Sales are final and no refund will be issued.
Annual Subscriptions
A 7-day refund window is available for annual subscriptions following the first purchase. If you are on an annual paid plan, you are entitled to a full refund within 7 days of your initial subscription. The Biscuit Factory will not grant refund requests made more than 7 days from the date of your initial plan purchase.
For example, if you register for a Factory annual plan on March 1st, 2024, you will be eligible for a refund until March 7th, 2024. If you do not request a refund within this period, you will not be eligible for a refund.
Please email marina@biscuit.ie with proof of purchase date to request a refund. Refund Processing If you qualify for a refund pursuant to this policy, the Company will promptly issue an instruction to its payment processor to issue the refund.
The refund amount will be less any payment processor fees and administrative fees.

Since we have a clear and explicit Refund Policy that you have agreed to prior to completing the purchase of the Program, we do not tolerate or accept any type of chargeback threat or actual chargeback from your credit card company or payment processor. In the event that a chargeback is placed on a purchase or we receive a chargeback threat during or after your purchase, we reserve the right to report the incident to all three credit reporting agencies or to any other entity for inclusion in any chargeback database or for listing as a delinquent account which could have a negative impact on your credit report score. The information reported will include your name, email address, order date, order amount, and billing address. Chargeback abusers wishing to be removed from the database shall make the payment for the amount of the chargeback.
By choosing a payment plan, you authorize us to automatically charge your credit or debit card as outlined in the Fees section.
If your payment is declined, you must provide a new payment method promptly to avoid program interruption.
To receive a refund, you must meet the program's refund policy requirements. Otherwise, you're obligated to complete all payments, and we may collect any outstanding balance using any payment method on file.
The materials on Companies web site are provided 'as is'. Company makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Company does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
The Biscuit Factory reserves the right at any time, and without cost, charge, or liability, to terminate this Agreement at its sole discretion for any reason, including, but not limited to, a failure to comply with the terms of this Agreement. In addition, The Biscuit Factory may, in its sole discretion, at any time, temporarily or permanently suspend access to your account, Subscription, or Services for any violation or suspected violation of this Agreement.
In no event shall Company or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Companies Internet site, even if Company or a Company authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
The materials appearing on Companies web site could include technical, typographical, or photographic errors. Company does not warrant that any of the materials on its web site are accurate, complete, or current. Company may make changes to the materials contained on its web site at any time without notice. Company does not, however, make any commitment to update the materials.
Company has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Company of the site. Use of any such linked web site is at the user's own risk.
Company may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
Any claim relating to Companies web site shall be governed by the laws of the Island of Ireland without regard to its conflict of law provisions.
As an Instructor, You represent, warrant, and covenant that: No Submitted Content shall infringe or misappropriate any intellectual property right of a third party. But, if instructor use HEVC compression, it's the instructor's responsibility to pay the royalties to the MPEG-LA, the owner of HEVC patents as appropriate.
